These Terms of Service ("Terms") govern your access to and use of Madelir's websites, online store, products, and related services.
Throughout these Terms, "Madelir," "we," "us," and "our" refer to the business operating under the Madelir brand. "You" and "your" refer to visitors and customers using our services.
By placing an order or using our services, you agree to these Terms, subject to applicable law. Please read them carefully before making a purchase.
01. General Conditions
Madelir provides professional nail essentials, including customizable products intended for independent nail artists, salons, and other businesses.
You agree to provide accurate, complete, and current information when placing orders or communicating with us.
You must be legally capable of entering into a binding contract to make purchases through our online store.
We reserve the right to decline or cancel orders for legitimate reasons, including suspected fraud, unlawful activity, product unavailability, or an inability to fulfill the requested customization. Any payments collected for canceled, unfulfilled orders will be refunded as required by applicable law.
02. Products & Customization
Madelir offers both customized and non-customized products, subject to availability.
We make reasonable efforts to accurately represent product descriptions, materials, dimensions, colors, and customization options.
However, slight variations may occur due to manufacturing processes, material characteristics, screen displays, and printing techniques.
Customers are responsible for reviewing product specifications and customization requirements before completing their purchases.
We may decline customization requests that are unlawful, infringe intellectual property rights, contain prohibited content, or cannot reasonably be produced using our available materials and methods.
03. Artwork Submission & Ownership
Customers may submit logos, artwork, text, and other design materials for customization.
By submitting artwork, you represent that you own the submitted materials or have the necessary rights, licenses, or permissions to authorize their reproduction and use.
You grant Madelir and its authorized manufacturing partners a limited, non-exclusive license to use, reproduce, adjust, and transmit submitted materials as reasonably necessary to prepare artwork proofs, manufacture products, fulfill orders, and provide related customer support.
You retain ownership of your original artwork and branding materials.
Madelir does not acquire ownership of your submitted logos or original designs solely because they are used to fulfill your order.
We will not use customer-submitted artwork in public marketing materials without appropriate permission.
You agree not to submit materials that knowingly violate the intellectual property or other legal rights of third parties.
To the extent permitted by applicable law, you are responsible for claims arising from artwork you submit without the necessary rights or permissions.
04. Artwork Proofs & Approval
Customized orders require final artwork approval before production.
After receiving your order, Madelir will prepare a digital artwork proof for your review.
Customers are responsible for carefully checking all design details, including spelling, logos, placement, colors, and other customization specifications.
Final artwork approval authorizes Madelir to begin production according to the approved design.
Once approval has been submitted, voluntary changes or cancellations generally cannot be accommodated.
Artwork Approval Deadline
Customers must approve their artwork within 10 business days from the date the proof is sent.
If approval is not received within this period, Madelir will automatically cancel the order and issue a full refund.
Any extension must be agreed upon by Madelir before the deadline and remains subject to applicable shipping and refund requirements.
This provision does not restrict any rights provided by applicable law.
05. Pricing & Payment
All prices are displayed in U.S. dollars unless otherwise indicated.
Product prices, customization charges, shipping fees, discounts, and applicable taxes will be disclosed during the purchasing process.
Madelir reserves the right to change product prices and promotional offers prospectively without prior notice.
Price changes will not affect orders already accepted and paid for, except where an adjustment is agreed upon or permitted by applicable law.
Payments are processed through Shopify and supported third-party payment providers.
By completing a purchase, you authorize the applicable payment provider to charge the total amount displayed at checkout.
If an order cannot be fulfilled, we will provide the applicable refund.
06. Order Acceptance & Availability
Submitting an order does not guarantee that every requested product or customization can be fulfilled.
We may contact you if additional information, artwork adjustments, or product substitutions are necessary.
If a requested product or customization is unavailable, we will offer an appropriate alternative where possible.
Customers are not required to accept substitutions that materially differ from their original order.
If we cannot fulfill an order and no acceptable alternative is agreed upon, we will cancel the affected order or items and issue the applicable refund.
07. Production, Shipping & Delivery
Customized products are typically delivered within 14–20 business days after final artwork approval.
This estimated timeframe includes production, quality inspection, shipping, and delivery.
Actual delivery times may vary due to carrier delays, customs inspections, holidays, severe weather, or other unforeseen circumstances.
Shipping rates and eligibility for complimentary shipping are described in our Shipping & Returns Policy.
Orders of 200 pieces or more and eligible subscription orders qualify for complimentary standard shipping, subject to the applicable checkout terms.
If we cannot ship an order within the applicable promised shipping period, we will provide the notices, cancellation options, and refunds required by law.

08. Cancellations, Returns & Refunds
Customized products are generally not eligible for voluntary cancellation after final artwork approval.
Due to their personalized nature, customized products are not returnable for changes of mind or customer-approved design choices.
However, claims involving missing items, incorrect products, significant manufacturing defects, or other material problems will be reviewed in accordance with our Shipping & Returns Policy and applicable law.
Normal printing variations on textured abrasive materials may occur.

Nothing in these Terms limits rights or remedies that cannot legally be waived.
09. Subscriptions & Recurring Orders
Madelir may offer recurring product subscriptions through Shopify.
Subscription customers authorize recurring charges according to the pricing, frequency, and other terms disclosed when they enroll.
Eligible subscriptions currently offer a 10% discount and complimentary standard shipping.
Available delivery intervals may include 30, 60, or 90 days, as displayed during subscription enrollment.
Subscription orders renew automatically until canceled.
Customers may manage eligible subscriptions through the subscription management options provided by Madelir, including cancellation and, where available, pausing or skipping upcoming orders.
Cancellation of a subscription stops future recurring orders and charges after the cancellation takes effect. It does not automatically cancel an order that has already been processed or approved for production.
We will disclose material subscription terms, including recurring charges, billing frequency, and cancellation procedures, before enrollment.
Subscription terms are also subject to our separate Subscription Policy and applicable law.
10. Intellectual Property
Unless otherwise indicated, Madelir's website content, original photographs, product descriptions, branding, graphics, and other proprietary materials belong to Madelir or its respective licensors.
You may not reproduce, distribute, or commercially exploit our proprietary content without authorization, except as permitted by law.
Customer-submitted logos and artwork remain the property of their respective owners.
11. Website Use
You agree not to use our websites or services to:
Engage in fraudulent or unlawful activities
Submit materials that infringe the rights of others
Interfere with website functionality or security
Attempt unauthorized access to our systems
Distribute malicious software or harmful code
Misrepresent your identity or payment information
We may restrict access or decline transactions where reasonably necessary to protect our customers, business, or services.
12. Third-Party Services
Madelir uses third-party platforms and service providers, including Squarespace, Shopify, payment processors, manufacturing partners, and shipping carriers.
Certain services may be subject to additional terms established by those providers.
We are not responsible for independently operated third-party websites or services outside our control.
However, the use of third-party providers does not eliminate responsibilities Madelir may have under applicable law.
13. Disclaimer of Warranties
We make reasonable efforts to provide accurate product information and reliable services.
Except for warranties expressly provided by Madelir or required by applicable law, our websites and services are provided without additional guarantees regarding uninterrupted availability or error-free operation.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be disclaimed.
14. Limitation of Liability
To the extent permitted by applicable law, Madelir will not be liable for indirect, incidental, or consequential losses arising from use of our websites or products where such limitations are legally enforceable.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot lawfully be excluded or limited.
These Terms do not restrict legally required refunds, remedies for defective or undelivered goods, or other non-waivable rights.
15. Privacy
Your personal information is handled in accordance with our Privacy Policy.
Please review that policy to understand how we collect, use, and disclose information, including customer-submitted artwork and order details.
16. Changes to These Terms
We may update these Terms periodically to reflect changes in our products, services, business practices, or legal requirements.
Updated Terms will be posted on our website with a revised effective date.
Material changes affecting existing contractual rights will be handled in accordance with applicable law.
17. Governing Law
These Terms are governed by the applicable laws of the U.S. state in which Madelir's operating legal entity is established, subject to mandatory consumer protection laws and other applicable legal requirements.
